  6. Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note: Failure to include all of the above information may result in a delay in processing your DMCA notification or may render it invalid. Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

Procedure Upon Receiving a Valid Takedown Notice

Upon receipt of a valid DMCA Takedown Notice that substantially complies with the requirements listed above, EaOnWay.com will:

  1. Expeditiously remove or disable access to the material that is alleged to be infringing.
  2. Promptly notify the user who posted the material (if contact information is available) that the material has been removed or access has been disabled.

Procedure for Submitting a Counter-Notice

If you are a user of EaOnWay.com and you believe that material you posted was removed or access to it was disabled as a result of mistake or misidentification of the material, you may send a written counter-notification (“Counter-Notice”) to our Designated Agent listed above. Pursuant to the DMCA (17 U.S.C. § 512(g)(3)), your Counter-Notice must include substantially the following:

  5. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside the United States, for any judicial district in which EaOnWay.com may be found), and that you will accept service of process from the person who provided the original Takedown Notice or an agent of such person.

Procedure Upon Receiving a Valid Counter-Notice

Upon receipt of a valid Counter-Notice that substantially complies with the requirements listed above, EaOnWay.com will:

  1. Promptly provide the original complaining party (who submitted the Takedown Notice) with a copy of the Counter-Notice.
  2. Inform the complaining party that EaOnWay.com will replace the removed material or cease disabling access to it in not less than ten (10) and not more than fourteen (14) business days following receipt of the Counter-Notice, unless our Designated Agent first receives notice from the complaining party that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on EaOnWay.com’s system or network.

Policy Regarding Repeat Infringers

In accordance with the DMCA and other applicable laws, EaOnWay.com has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers of copyright. EaOnWay.com may also, at its sole discretion, limit access to the website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
